STATE OF COLORADO
Colorado Water Conservation Board
Department of Natural Resources
1313 Sherman Street, Room 721
Denver, Colorado 80203
Phone: (303) 866 -3441
FAX: (303) 866 -4474
www.cwcb.state.co.us
July 16, 2002
Greg Hoskin
Hoskin, Farina, Aldrich & Kampf
200 Grand Avenue, Suite 400
Post Office Box 40
Grand Junction, CO 81502
Dear Greg:
Bill Owens
Governor
Greg E. Walcher
Executive Director
Rod Kuharich
CWCB Director
Dan McAuliffe
Deputy Director
I received your July 11, 2002 correspondence. With this letter I am forwarding a copy of
your letter to all of the Board. members so that they may be aware of your concerns.
I appreciate your concerns about the schedule and I recognize that they are valid.
However, the vast majority of Board members expressed concerns to me verbally that the
original Hearing Coordinator's schedule for the Pueblo RICD Hearing was too long. The
new proposed schedule was an attempt to shorten the hearing length while preserving
each parties' ability to adequately present testimony.
You asked several questions. First, regarding the Board's deliberations that are scheduled
for 90 minutes, you ask what my plan is if we have "an overrun of time on the RICD matter."
It is my hope that Board members will be efficient with their comments and their
deliberations so that we may conclude deliberations on Tuesday morning.
However, the Board may continue those deliberations from 12:30 to 1:00, and potentially
past the 1:00 time. In addition, while the Board's special telephonic Board meeting at 10:30
on August 5, 2002 (a copy of that notice that went out on 6/3/2002 is attached for your
convenience) was intended to review a written copy of the Staff's draft of a Board
recommendation and findings, the Board may decide to carry over its deliberations until
that time. However, this would not be ideal.
You also ask if we discussed the proposed schedule change with the Hearing Coordinator
and whether she gave her approval. The Hearing Coordinator is out of the country until
July 20, so we did not discuss the proposed schedule change with her. We did discuss this
matter with the alternate Hearing Coordinator, Dan McAuliffe, and he does not have any
issues with the proposal to amend the schedule. However, the ultimate decision about
whether to amend the schedule is up to the Board.
Sincerely
Rod Kuharich
cc: Board members
Attachments
Flood Protection • Water Supply Planning and Finance • Stream and Lake Protection
Water Supply Protection • Conservation and Drought Planning
