i. If the Application is granted, Applicant's water rights pursuant to this
Application should be operated and administered only in a manner consistent with
Southeastern's exercise and use of its decreed water rights.
J. If the Application is granted, appropriate terms and conditions must be
imposed to prevent injury and to ensure proper administration.
k. If the Application is granted, the Court should require sufficient record -
keeping, accounting, and reporting to ensure compliance with all terms and conditions necessary
to prevent injury.
1. Southeastern reserves the right to raise the objections raised by other
parties in statements of opposition, but not repeated here.
M. Additional grounds of objection may be identified as Southeastern learns
more of the Applicant's proposals.
n. This Statement of Opposition is a continuing objection to any amended or
republished Application, or motion to amend statement of claim.
WHEREFORE, the Southeastern Colorado Water Conservancy District respectfully
requests that the Application be denied and /or that the scope of the Application be limited to its
proper extent, that terms and conditions be imposed to the extent necessary, and for such other
and further relief as the Court determines just and proper.
Respectfully submitted this 27th day of July, 2006.
BURNS, FIGA & WILL, P.C.
(Original signature of Lee E.
