All notices required by law -were complied with and this Court has jurisdiction overthe subject <br />matter of this proceeding. <br />5. The waste water rights which are the subject of this Application and are owned by the <br />Applicant are: <br />NAME: Ransford Waste Water and Pond. <br />LOCAZTON: The outflow of a circular pond being approximately 100 feet in width by 100 feet <br />in length with a maximum depth of 8 feet on a slope with 0.23 acre foet of surface <br />area, a total capacity of 0.613 acre feet, and dead storage of approximately 0-153 <br />acre feet, located in the SE1 14 NE1/4 of Section 4, Township 34 North, Range 8 <br />West, N.M.P.M., being 160 feet from the East section line and 1500 feet from. the <br />North section line. The point of diversion being the outlet of the said pond from <br />which 7.3 gallons per minute (0.0162 c.f.s.) is captured from waste waterpro duced <br />from a gas well on the Applicant's property, being Ransford Well 4 -4. The storage <br />capacity of the pond being 0.613 acre feet to irrigate approximately 10 acres, as <br />identified on the attached Exhibit A. <br />SOURCE: Waste water that is abypro duct pro duced from a gas well being Ransfoxd Wall 4 .4. <br />A.PPROPRUTION A.A.TE:'May 30, 2002. <br />AMOUNT: 7.30 g.p.m. (0.0162 c.f.s.) Conditional. <br />USE: Waste water from surface discharge of the existing gas' well on the Applicant's <br />property will be collected in a pipeline system and transferred to a holding pond and <br />thereafter applied through an irrigation system to irrigate 10 acres located in the SE1 /4 <br />NE1 /4 of Section 4, Township 34 North, Range 8 West, N.M.P.M_, La Plata County, <br />Colorado, owned by the Applicant. <br />6, The Applicant shall comply with the Orders of the Division Engineer to install necessary <br />measuring devices, and shall keep records and make reports as reasonably requested•by the Division <br />Engineer. <br />7. The total amount of water diverted at any one point or combination of points cannot exceed <br />the decreed amount pertaining to this priority or the amount available at the original point of <br />diversion. <br />8. The water, which is the subject matter of this Application, is a by- product of the gas wells, <br />which is not expected to create a permanent water source.
