courts, Justice Hobbs appeared as attorney of record for Northern in Riverside Irr. Dist. v. <br />Andrews, 758 F.2d 508 (10"' Cir. 1985), and Riverside Irr. Dist. v. Stipo, 658 F.2d 762 (10`' Cir. <br />1981). <br />As evidence of Justice Hobbs' close ties and intimate association with Northern, Golden <br />invites the Court to consider the biography of Justice Hobbs that appears on the internet web site <br />maintained by the Appellant, the Colorado Water Conservation Board.' Affidavit, ¶ 2 and <br />biography attached thereto. His extensive work for Northern is detailed in that biography, and <br />that one client is mentioned eight times in just two pages. Id. <br />Significantly, it appears that Justice Hobbs has recused himself in past cases before the <br />Supreme Court where Northern was a parry. See Municipal Subdistrict, Northern Colorado <br />Water Conservancy Dist. v. Getty Oil Exploration, Co., 997 P.2d 557 (Colo. 2000); Municipal <br />Subdistrict Northern Colorado Water Conservancy District v. Oxv USA, Inc., 990 P.2d 701 <br />(Colo. 1999); Municipal Subdistrict Northern Colorado Water Conservancy District v. Chevron <br />Shale Oil Co. 986 P.2d 918 (Colo. 1999); City of Thornton v. Bijou Irr. Co., 926 P.2d 1 (Colo. <br />1996). <br />The policy concerns implemented by C.R.C.P 97, C.R.S. § 13 -1 -122, and Judicial <br />Cannons 2 and 3 are equally present whether a former client is a regular party to a case, or an <br />amicus parry as in this case. Indeed, the plain language of these rules draw no distinction that <br />'Justice Hobbs' biography, a video featuring him, an essay and a poem by him, can all be <br />viewed on Appellants' website at: http:/ /cwcb.state.co.us/Edu_Res_Guide /start.htm. The <br />biography of Justice Hobbs on that web site expressly mentions Justice Hobbs' high regard for <br />the Colorado Water Conservation Board (the Appellant) and its instream flow program (which <br />Appellant has made an issue in this appeal). It also mentions Justice Hobbs' long association <br />with David Robbins, author of the Colorado Water Congress brief discussed below, including <br />their work together on the instrearn flow program, which Appellants have also made an issue in <br />this appeal.
