This matter involves the application brought by Upper Gunnison for a <br />recreational in- channel diversion ( "RICD "), the first case to be tried under Senate Bill 216, <br />C.R.S. §§ 37 -92 -101 et seq. As provided in C.R.S. § 37 -92- 102(6), a hearing was held before the <br />Colorado Water Conservation Board ( "CWCB ") on September 10, 2002. The Board of Directors <br />deliberated both at that hearing and by telephone conference on October 1, 2002. CWCB issued <br />its written Findings and Recommendations on October 11, 2002. <br />
