(30) Enforceability. 'This agreemeni, when executed and delivered by each party as a <br />party hereto, will constitute a legal, valid and binding obligation of it, enforceable against <br />it in accordance with the terms hereof. <br />(31) Joint Draft. T'he parties agree they drafted this Agreement jointiy with each <br />having the advice of legal counsel and an equal opportunity to contribute to its content. <br />(32) Condemnation. If any individual or entity with the power of eminent domain <br />initiates or gives notice that it intends to initiate condemnation proccedings with respect <br />to any interest in the HRWP project, its faciliries, or the land on which it is located, <br />Lower shall notify SPWRAP thereaf in writing within five days and grovide SPWRAP <br />copies of all correspondence, pleadings and other documents regarding the proposed <br />condemnations. <br />(33) Non-business Days. If the date for any action under this Agreement falls on a <br />Saturday, Sunday or a day that is a"holiday" as such term is defined in Rule 6 of the <br />Colorado Rules of Civil Procedure, then the relevant date shall be extended automatically <br />until the next day that is not a Saturday, Sunday or a"holiday." <br />— Remainder of Page Intentionally I.eft Blank — <br />j� HRWP Project Specific Agr 1-2]-09 <br />
