STATE'S OBLIGATIONS FOR APPROPRIATIONS <br />with Article 26 herein, the State intends to fulfill its obligations under this Contract. <br />reasonably believes that funds in amount sufficient to fulfill these obligations lawfully <br />can �nd will be available for this purpose. In the event funds are not appropriated in amounts <br />to fulfill these obligations, the State shall use its best efforts to satisfy any requirements <br />for jayments or contributions of funds under this contract from any other source of funds legally <br />for this purpose. Nothing herein shall constitute, nor be deemed to constitute, an <br />of future appropriations by the General Assembly of the State of Colorado where <br />such an obligation would be inconsistent with Colorado Revised Statutes or the <br />10 Colorado Constitution. <br />11 <br />12 13. COVENANT AGAINST CONTINGENT FEES <br />13 Thi State warrants that it has not employed or retained any person or selling agency to solicit or <br />I4 sec ire this contract upon an agreement or understanding for a commission, percentage, <br />15 br erage or contingent fee, excepting bona fide employees or bona fide established commercial <br />16 or elling agencies maintained by the State for the purpose of securing business. For breach or <br />17 vi ation of this warranty, the United States shall have the right to annul this contract without <br />18 lia ility, or at its discretion, to add to the repayment obligation or consideration the full amount <br />19 of uch commission, percentage, brokerage, or contingent fee. <br />20 <br />21 14.
