th BORROWER shall provide the as -built drawings to the State Engineer's Office for
ap roval and filing.
K. Uppn completion of the PROJECT construction, the BORROWER shall arrange a final
ins ection for the CWCB staff.
L. Tht BORROWER shall pay all of the expenses related to the PROJECT when such bills
arl due.
SECTION q— ELIGIBLE EXPENSES. The following items are eligible for loan disbursements.
A. Preparing final designs and specifications for the PROJECT.
B. Pr paring bid and construction contract documents.
C. Pr paring environmental assessment or environmental impact statements, and
of erwise complying with the Federal National Environmental Policy Act.
D. C plying with all federal, state, and local regulatory requirements, including the
ob aining of all required permits.
E. Fi and wildlife mitigation measures required by federal, state, or local laws and
re ulations.
F. Ac ual construction as called for in the design documents and in change orders
ap roved by the CWCB and the BORROWER.
G. En 3ineering services for construction management, including design and
coi istruction management for CWCB- approved change orders.
H. Int rest during completion of the PROJECT pursuant to Paragraph AA of the
1. Le al services for reviewing engineering services contracts, reviewing this Contract,
re ewing construction contract documents, and for complying with all federal, state,
an local regulatory requirements.
J. PR JECT- related expenses incurred prior to the Effective Date of this contract in
ac ordance with the approval of this loan.
10 — DISBI IRSEMENT SCHEDULE
Foi Project costs: The BORROWER shall prepare a periodic progress report which
cor tains a statement of the PROJECT costs expended for that period and shall
fonvard said statement to the CWCB. After receipt of the periodic progress report
froi n the BORROWER, and review and acceptance of the items therein as eligible
exr erases as described below, the CWCB will pay to the BORROWER the amount set
fori 1 in the report or such portion that has been approved by the CWCB. Such
pa ment shall be made within thirty (30) days from the CWCB's approval of each
prc gress report.
SECTION 1 I — TIME FOR PERFORMANCE
PR JECT Beginning: Upon Effective Date of this Contract (the date this contract is
sig ied by the State Controller or his designee).
PR JECT Finish: Four (4) years from the Effective Date of this Contract.
