Make findings of fact in the event of the occurrence of extraordinary
drought…in the Upper Basin, which makes Treaty deliveries by the
Upper Basin difficult, and report these findings to the Upper Basin
state Governors, the President, the IBWC , and other federal
agencies as appropriate “to the end that the water allotted to Mexico
under Division III of such treaty may be reduced in accordance with
the terms of such Treaty.” Article VIII(d)(10):
The UCRC does not have authority to determine how curtailment
will be implemented within an individual state.
