Operation of change of water rights. The Subject Water Rights will not be <br />diverted from the stream at the headgate of the Peabody #1 Ditch , but will instead <br />remain in the stream for instream flow use by the CWCB to preserve and/or improve the <br />natural environment to a reasonable degree within the CWCB Instream Flow Reaches in <br />accordance with the CWCB change of water rights in Case No. 06CW264. The HCU <br />Credits will be available for use by Applicants below the CWCB Instream Flow Reaches <br />as follows. <br />1. Volumetric HCU Credits.
