Existing Water Right Information
Staff has analyzed the water rights tabulation and consulted with the Division Engineer's Office
(DEO) to identify any potential water availability problems. Four decreed surface diversions
were identified within this reach of stream (Big Rock Ditch, Frey Ditch, L Ranch Ditch and
Layton and Cloone Ditch). According to the DEO, there is usually sufficient water available
within this stream reach to satisfy the recommended instream flow amount. Based on this
analysis, staff has determined that water is available for appropriation on Anthracite Creek, from
Ruby Anthracite Creek to Coal Creek, to preserve the natural environment to a reasonable degree
without limiting or foreclosing the exercise of valid existing water rights.
CWCB Staff's Instream Flow Recommendation
Staff recommends the Board form its intent to appropriate on the following stream reach:
Segment: Ruby Anthracite to Coal Creek
Upper Terminus: Ruby Anthracite Creek
(Latitude 38° 57' 15 "N) (Longitude 107° 12' 46 "W)
UTM = 43 14 037 N 13 3 08 243 E
NE SW S3 T13S R88W 6PM
2100' East of West Section Line 2800' North of South Section Line
Lower Terminus: Coal Creek
(Latitude 38° 55' 37 "N) (Longitude 107° 20' 27 "W)
UTM = 43 11 270N 13 2 97 081E
NW NE S16 T13S R89W 6PM
2100' West of East Section Line 750' South of North Section Line
Watershed: North Fork Gunnison River (HUC #:14020004)
Counties: Gunnison
Length: 8.0 miles
USGS Quad(s): Marcellina Mt., Paonia Reservoir
Flow Recommendation: 54 cfs (April 1— July 14)
39 cfs (July 15 — August 14)
17 cfs (August 15 — March 31)
6
