3. The source of the water is:Little Dolores River <br /> 4. Legal description of the stream segment through which an instream flow is <br /> claimed: <br /> a. The natural stream channel at the confluence of Bieser Creek at latitude <br /> 38° 59' 13"N and longitude 108°54' 48"W as the upstream terminus <br /> and extending to the Upper Saxbury Ditch at latitude 39° 00' 28"N and <br /> longitude 108° 56' 12"W as the downstream terminus,being a distance <br /> of approximately 2.5 miles, This segment can be located on the Bieser <br /> Creels and the Sieber Canyon U.S.G.S. quadrangles. <br /> b. For administrative purposes only: <br /> Upper Terminus=SW NW 828 T12S R103W 6PM <br /> UTM 43 17 190N 12 6 80 744E <br /> 1230'East of West Section Line,2000' South of North Section Line <br /> Lower Terminus'SE SE S18 T128 RIO3 W 6PM <br /> UTM 43 19 472N 12 6 78 657E <br /> 360'West of East Section Line,450'North of South Section Line <br /> 5. Use of the water <br /> Instream flow to preserve the natural environment to a reasonable degree. <br /> 6. Date of initiation of appropriation: <br /> Januaty 28,2004 <br /> 7, The water was first applied to the above beneficial use on January 28,2004, <br /> by the action of the Colorado Water Conservation Board under the provisions of C.R.S. <br /> 4 37-92-102(3)and 3792-103(3),(4)and(10). <br /> 8. Amount of water claimed(ABSOLUTE):lnsteam flow of 2.4 cfs(April 1 — <br /> June 30), 1.6 efs(July 1 -October 31),and 1.0 cfs(November 1-March 31). <br /> THE WATER REFEREE RULES: <br /> The application is granted and a decree(ABSOLUTE)in the amount of 2.4 cfs <br /> (April 1—June 30), 1.6 cfs(July 1 -October 31),and 1.0 cfs(November 1 -March 31)is <br /> hereby entered to preserve the natural environment to a reasonable degree in the reach of <br /> Little Dolores River between the upstream and downstream points described in paragraph <br /> 4 above. The appropriation date for this water right is January 28,2004. <br /> The priority herein awarded was filed in the water court in the year of 2004 and <br /> shall be junior to all priorities filed in previous years. As between all rights filed in the <br /> same calendar year,priorities shall be determined by historical date of appropriation and <br />
