4. Objectors: A Statement of Opposition was filed in this matter by Pat A. Richards and the time for filing additional Statements of Opposition has expired. Richards & Richards, a Colorado general partnership, has been substituted as the Opposer in this matter pursuant to C.R.C.P. 25(a) due to the death of Pat A. Richards. 5. Consultation. The Division Engineer filed a Summary of Consultation pursuant to § 37 -92- 302(4) C.R.S. dated June 11, 2003 and the Referee has given it due consideration. 6. Name of Natural Stream: La Sal Creek, tributary to the Dolores River. 7. Location: a. Legal description of the stream segment through which an instream flow is claimed: The natural stream channel from the confluence with Sharp Canyon at latitude 38° 19' 25.96 "N and longitude 108° 59' 34.38 "W as the upstream terminus and extending to the confluence with the Dolores River at latitude 38° 16' 42.96 "N and longitude 108° 55' 53.37 "W as the downstream terminus, being a distance of approximately 7.9 miles. This segment can be located on the Paradox U.S.G.S. quadrangle. b. For administrative purposes only: Upper Terminus = SE SW S17 T47N R19W NMPM 1138' North of the South Section Line, 2391' East of the West Section Line UTM North: 4249300.6 UTM East: 150917.1 Lower Terminus = SW SE S35 T47N R19W NMPM 409' North of the South Section Line, 1569' West of the East Section Line UTM North: 4244043.4 UTM East: 156072.1 8. Use of the water: Instream flow to preserve the natural environment to a reasonable degree. 9. Date of initiation of appropriation: January 23, 2002 10. The water was first applied to the above beneficial use on or before January 23, 2002, by the action of the Colorado Water Conservation Board on January 23, 2002 under the provisions of C.R.S. § § 37 -92- 102(3), (4) and (10). 11. Amount of water claimed (ABSOLUTE): Instream flow of 5.1 cfs (March 15 — June 14), 1.2 cfs (June 15 — December 14) and 3.0 cfs (December 15 — March 14).
