4. Objectors: A Statement of Opposition was filed in this matter by Pat A. <br />Richards and the time for filing additional Statements of Opposition has expired. <br />Richards & Richards, a Colorado general partnership, has been substituted as the <br />Opposer in this matter pursuant to C.R.C.P. 25(a) due to the death of Pat A. Richards. <br />5. Consultation. The Division Engineer filed a Summary of Consultation pursuant <br />to § 37 -92- 302(4) C.R.S. dated June 11, 2003 and the Referee has given it due <br />consideration. <br />6. Name of Natural Stream: La Sal Creek, tributary to the Dolores River. <br />7. Location: <br />a. Legal description of the stream segment through which an instream flow is <br />claimed: The natural stream channel from the confluence with Sharp <br />Canyon at latitude 38° 19' 25.96 "N and longitude 108° 59' 34.38 "W as the <br />upstream terminus and extending to the confluence with the Dolores River <br />at latitude 38° 16' 42.96 "N and longitude 108° 55' 53.37 "W as the <br />downstream terminus, being a distance of approximately 7.9 miles. This <br />segment can be located on the Paradox U.S.G.S. quadrangle. <br />b. For administrative purposes only: <br />Upper Terminus = <br />SE SW S17 T47N R19W NMPM <br />1138' North of the South Section Line, 2391' East of the West Section Line <br />UTM North: 4249300.6 UTM East: 150917.1 <br />Lower Terminus = <br />SW SE S35 T47N R19W NMPM <br />409' North of the South Section Line, 1569' West of the East Section Line <br />UTM North: 4244043.4 UTM East: 156072.1 <br />8. Use of the water: Instream flow to preserve the natural environment to a reasonable <br />degree. <br />9. Date of initiation of appropriation: January 23, 2002 <br />10. The water was first applied to the above beneficial use on or before January 23, <br />2002, by the action of the Colorado Water Conservation Board on January 23, 2002 under <br />the provisions of C.R.S. § § 37 -92- 102(3), (4) and (10). <br />11. Amount of water claimed (ABSOLUTE): Instream flow of 5.1 cfs (March 15 — <br />June 14), 1.2 cfs (June 15 — December 14) and 3.0 cfs (December 15 — March 14). <br />
