GRANTEE: San Luis Valley Irrigation Agency Name: Water Conservation Board <br />District Agency Number PDA <br />Contract No. C150402 Routing Number �' �i � � � �'�' �� �' �% � <br />Grant Amount $288,000.00 <br />GRANT CONTRACT <br />THIS CONTRACT, made this May 30, 2007, by and between the State of Colorado for <br />the use and benefit of the Department of Natural Resources, Colorado Water Conservation <br />Board, hereinafter referred to as the CWCB and/or STATE, and the SAN LUIS VALLEY <br />IRRIGATION DISTRICT, P.O. Box 637, Center, CO 81125-0637, hereinafter referred to as the <br />GRANTEE or CONTRACTOR. <br />FACTUAL RECITALS <br />A. Authority exists in the law, and funds have been budgeted, appropriated and otherwise <br />made available and a sufficient unencumbered balance thereof remains available for <br />payment in Fund Number 424 Organization RIOG, Appropriation H2O, GBL R402 Program <br />WTRC, Object Code 5180, Contract Encumbrance Number C150402. <br />B. Required approval, clearance, and coordination have been accomplished from and with <br />appropriate agencies. <br />C. The CONTRACTOR is a Colorado irrigation district formed and operating pursuant to <br />C.R.S. Title 37, Article 41. <br />D. The CONTRACTOR previously received a nonreimburseable expenditure from the CWCB <br />for the purpose of conducting a study of the multiple-use enlargement of Rio Grande <br />Reservoir (Phase I Study). <br />E. Based upon the results of the Phase I Study, the CONTRACTOR has requested another <br />nonreimburseable expenditure for the purpose of developing a pre-design of the multiple- <br />use enlargement of Rio Grande Reservoir ("PROJECT"). <br />F. The CWCB has determined that the PROJECT will benefit municipalities and other water <br />providers in the Rio Grande valley, and will assist the CWCB in its water resource <br />planning efforts. <br />G. Authority for the agency entering into this contract arises from Colorado Revised Statutes <br />(CRS) 39-29-109(1)(a)(III), 37-75-102 and 37-74-104(2)(c) and Senate Bill 06-179 <br />adopted by the 2006 General Assembly. <br />H. At its March 2007 meeting, the CWCB approved a nonreimbursable expenditure for the <br />PROJECT to the GRANTEE in an amount up to $288,000.00. <br />NOW THEREFORE, in consideration of the mutual and dependent covenants contained <br />Grant Contract No. C150402 <br />Page 1 of 7 <br />
