0 <br />Contract dated June 3, 1958 (Contract No. 14-06-500340), the care, <br />operation and maintenance of Platoro Dam and Reservoir and <br />appurtenant works and fac.ilities were transferred to the Contractor <br />effective June 15, 1991; and <br />WHEREAS, the Reclamation Projects Authorization and Adjustment <br />Act of 1992, Public Law 102-575, authorizes the permanent transfer <br />of operation, maintenance and replacement responsibilities for <br />Platoro Dam and Reservoir from the United States to the Contractor, <br />provided that the Contractor makes a lump sum payment to the United <br />States in lieu of the construction repayment obligations in the <br />Repayment Contract; and <br />WHEREAS, the total cost for the Contractor to acquire such <br />responsibilities for Platoro Dam and Reservoir is $450,000; and <br />WHEREAS, pursuant to Senate Bill No. 15, First Session of the <br />Fifty-Sixth General Assembly of the State of Colorado duly enacted <br />into law, the Colorado Water Conservation Board has been authorized <br />to loan and grant the sum of $500,000 to the Contractor for the <br />transfer of operation, maintenance and replacement responsibilities <br />for Platoro Dam and Reservoir, $400,000 of which is to be <br />reimbursable at 5% interest over 40 years and $100,000 of which is <br />to be non-reimbursable in recognition that the State shall receive <br />the right from the Contractor to a portion of Platoro <br />Reservoir's storage capacity fo� e of ineeting Colorado's <br />obligations under the Rio Grand and <br />WHEREAS, pursuant to House '1 ����`Ob� First Session of <br />the Fifty-Eighth General Ass h � of Colorado duly <br />enacted into law, amending Se B 1 0. 15, the Colorado Water <br />Conservation Board was authorized to expend up to $50,000 from the <br />$400,000 loan portion of the total authorization for preparation of <br />an operational model as the basis for an operating agreement for <br />Platoro Dam and Reservoir between the Contractor and the State <br />Engineer; and <br />WHEREAS, the Contractor and the State entered into a Computer <br />Modelling Contract on May 21, 1992 for the loan of $50,000 for <br />preparation of the operational model, $30,000 of that loan has been <br />disbursed to the Contractor, and the remainder shall be disbursed <br />upon acceptance of the model by the Contractor and the State; and <br />WHEREAS, House Bill 91-1006 also required that no additional <br />moneys may be expended by the State on the Platoro Reservoir <br />Project until after the State Engineer certifies to the Colorado <br />Water Conservation Board that an operating agreement satisfactory <br />to him has been entered into for the State's use of a portion of <br />the Reservoir storage capacity for the purpose of ineeting <br />Colorado's obligations under the Rio Grande Compact; and <br />2 <br />
