APPENDIX A
RESOLUTION
�
WHEREAS, the Board of directors of the "Cone3os Water
Conservancy District has determined that it is in the best
interests of the District water users to create and maintain a
water activity enterprise pursuant to Section 37-45.1-103 of the
Colorado Revised Statutes for the purpose of administering the
storage and distribution of water in Platoro Reservoir, and the
revenue produced from the sale of such stored water; and
WHEREAS, the Board of Dlrectors of the Conejos Water
Conservancy District has determined that the name of the
enterprise shall be Platoro Reservoir Enterprise; and
WHEREAS, Platoro Reservoir Enterprise shall be wholly owned
by the Cone,los Water Conservancy District; and
WHEREAS, the Board of Directors of the ConeJos Water
Conservancy District, in addition to their regular duties in
connection therewith, shall also serve as the Board of Directors
of Platoro Reservoir Enterprise; and
WHEREAS, the Board of tors of Platoro Reservoir
Enterprise may exercise uthority of the Cr.,nejos Wat�r
� Conservancy District relat wat r ctivities apptrtaining to
Platoro Reser.voir, but ma not a ax which is subject to
Section 20(4) of Article X f S Constitution; and
WHEREAS, the Boar o Directors of the Conejos Water
„ Conservancy District he eby determines that the purpose for the
creation of Platoro Reservoir Enterprise is to operate, maintain,
repair and replace the Platoro Reservoir Project, and to coi�duct
watQr activities that include, but are not limited to the
� diversion, storage, carriage, delivery, distribution, use,
augmentation, exchange, reuse or discharge of water, as well as
� storage for interstate compact obligations, and includes the
provision for the wholesale or retail sale of water, and the
acquisition of water or water rights.
NOW, THEREFORE, BE.IT RESOLVED that the Board of Directors
of the ConeJos Water Conservancy District hereby creates an
enterprise, named Platoro Reservoir Enterprise, and names the
Board of Dtrectors of t�e Cone,los Water Conservancy Dfstrict to
also serve as the Board of Directors of Platoro Reservoir
Enterprise.
BE IT FURTFIER RESOLVED that a separate accountin,g of funds
of Platoro Reservoir Enterprise will be distinct ;and separate
from all other funds of the ConeJos Water Conservancy District.
