Box 127 <br />Dolores, CO 81323 <br />RE: MVIC/Suxnmit Irrigation Company Feasibility Study <br />:Dear Mr. Sanford: <br />In November 2008, Applegate Group, Inc. entered into a contract with Slunmit Reservoir and <br />Irrigation Company (Summit) concerning the above referenced Study. On March 30, 2009, the <br />State issued a Purchase Order from the Water Supply Reserve Account for the Study with an <br />anticipated completion date of August 30, 2009. <br />�_ <br />In A ril d M f this ear w ini ' f <br />an a o e t i a t e d o u r i n v e s t i a t i o n s w h i c h i n c l u d e d d i s c u s s i o n s o a r e a <br />I, P Y Y� g <br />operations with various individuals including you and Summit's Board, Mr. 7im Siscoe (MVIC), <br />1VIr. Mike Preston (DWCD), Division of Water Resources staff, and other individuals. These <br />discussions were held to identi ossible issues or concerns that ma need to be addressed from ` <br />' fY p y <br />our investigations. As you know, the DWCD operates the Dolores Project and manages <br />deliveries ,of water from McPhee Reservoir, including deliveries to MVIC. Therefore, having an <br />_ <br />: understanding of DWCD operations as they pertain to MVIC is essential to our work. We were <br />_ <br />ro ressin to ain additional information from DWCD but as ou axe aware a lawsuit is now <br />p g g g <br />, , <br />� <br />Y <br />pending between MVIC and DWCD. <br />I', Unforlunately, it is unlikely that we will be able to gain further information from DWCD until <br />the lawsuit is settled and essentially, things have been put on hold. With this new problem, we <br />cannot complete our study by the August 30, 2009 deadline and would ask Summit to consider <br />an extension of time for us to complete our work. At this time, I would suggest an extension <br />until August 2010 to allow completion of the lawsuit between MVIC and DWCD. In the event <br />th <br />e case is not settled b:then, we will need to revisit the antici ated com letion date.
