8. Copies of the notarized and recorded Grants of Easement from all property owners <br />where the proposed raw water irrigation system encroaches upon their real property. <br />9. Permits and approvals from Eagle County for the cross-cuts this project plans to make <br />in Eagle County roads, permits and approvals from the Eagle County Engineering <br />Department for this project, as well as any other governmental or environmental agency <br />whose approval is necessary. <br />10. Written proof of bids received for all phases of construction at or below estimates <br />($1,200,000.00). <br />I1. A complete detailed accounting for all expenses incurred and/or paid, from April 1, <br />1997 through March 31, 1998, by the Association in conj unction with the raw water <br />irrigation system including, but not limited to, all time spent on this project by any <br />employees, the costs of surveyors, lawyers, and/or any other persons (or companies) who <br />have been employed in conjunction with this installation of this system, the costs of <br />plans, loan application fees, supplies and postage for mailings pertaining to this system <br />and any other expenses that would normally not be incurred by the Association in its <br />day-to-day operations. <br />12. The Balance Sheets and Income Statements for the Blue Lake Owners' Association for <br />the periods ending 12/31/97, 1/31/98 and 2/28/98. <br />13. Copies of the minutes of all BLOA Board of Directors' meetings held between May 15, <br />1997 and March 31, 1998. <br />Items 1 through 10 on the above list are the items that were printed on the back of the "Notice for Special <br />Meeting" for 12/4/97 (copy enclosed), wherein the Board states "In order for the Blue Lake Owners <br />Association to proceed with installation of an imgation system, the following items MLTST be completed <br />prior to March 31, 1998". In order to insure compliance with the Covenants and with the conditions the <br />Board imposed upon itself in said Notice, and under which the $14.00 special assessment was <br />conditionally granted, we are requiring proof of the completion of Items 1 through 10 above. The Notice <br />fiirther states that otherwise "the additional assessment collected from January, February and March will <br />be credited to your April statement." If the Board cannot produce proof of its compliance with all of Items <br />1 through 10 in our above itemized requests on March 31s`, 1998 at 2:00 PM then, in order to comply with <br />the conditions under which the $14.00 special assessment was granted, the homeowners' special <br />assessment money would be credited to their accounts and there would be no need for the "public <br />meeting" on Apri18, 1998 referenced in Peter Delaney's 3/18l981etter, since there would be no irrigation <br />system to "discuss". <br />On the date and time specified above, if the Association fails to produce all (Items 1 through 13) of the <br />documents requested above, or if the Blue Lake Owners' Association Office, located at 0189 J.W.
