Legal description of the lake: <br />The lake is located in the SW /4 NE /4, Sec. <br />19, T5S, R87W, 6th P.M., in Garfield County, <br />Colorado. The lake is located in the natural <br />drainage of East Dead Horse Creek and can be <br />located on the Shoshone U.S.G.S. quadrangle <br />and is depicted on Exhibit A. <br />4. Date of initiation of appropriation: <br />November 26, 1996. <br />5. The water was first applied to the above beneficial use <br />on November 26, 1996, by action of the Colorado Water Conserva- <br />tion Board pursuant to the provisions of §§ 37- 92- 102(3), and <br />37 -92- 103(3),(4), and (10), 15 C.R.S. (1990 Repl. Vol.), and <br />§ 37-92-102(4), 15 C.R.S. (1996 Supp.) . <br />6. Amount of water claimed (ABSOLUTE): Five (5) acre - <br />feet. This is the amount of water necessary to preserve the <br />natural elevation of the water surface at approximately 7,170 <br />feet, as derived from the appropriate U.S.G.S. quadrangle map. <br />THE WATER REFEREE RULES: <br />The application is granted and a decree (ABSOLUTE) in the <br />amount of Five (5) acre -feet is hereby entered to preserve the <br />natural environment to a reasonable degree in the natural lake as <br />described in paragraph 6 above. The appropriation date for this <br />water right is November 26, 1996. <br />The priority herein awarded was filed in the water court in <br />the year of 1996 and shall be junior to all priorities filed in <br />previous years. As between all rights filed in the same calendar <br />year, priorities shall be determined by historical date of <br />appropriation and not affected by the date of entry of ruling. <br />The Applicant shall install and maintain such measuring devices <br />and keep such records as the Division Engineer may require for <br />administration of this right. <br />2 <br />
