Legal description of the stream segment through which an instream flow is <br />claimed. � <br />The natural stream channel from the north sectioni line of the NE/4 <br />NE/4, Sec. 5, T9S, R80W, 6� P.M.as the upstream terminus and <br />extending to the confluence of St. Kevin Gulch in the NE/4, NE/4, <br />Sec. 8, T9S, R80W, 6th P.M. as the downstrea.m terminus, being a <br />� distance of appraximately 1.2 miles. This segment can be Iocated <br />on the Lead'ville North U.S.G.S. quadrangle. <br />5. Use of the water: <br />Instream flow to preserve the natural environment to a reasvnable degree. <br />6. Date of initiation of appropriation: <br />December 9,1998. <br />7. The water was first applied to the above beneficial use on December 9,1998, by <br />action of the Colorado Water Conservation Board under the provision of C.R.S. §§ 37-92-102(3), <br />37-92-103(3), (4), (10). <br />8. Amount of water claimed (ABSOLUTE): Insireazn flow of 19.0 c.f.s. (May 15 - <br />July 31); 7.0 c.f.s. (August 1- October 14); 4.5 c.f.s. (October 15 —May 14). <br />THE COURT RULES: <br />The application is granted and a decree (ABSOLUTE) in the amount of 19.0 c.f.s. (May <br />15 - July 31); 7.0 c.f.s.
