The proposed program meets all of the requirements when issuing a permit in section 36-20-112, C.R.S., <br /> it is hereby determined that the permit is approved with the following conditions, which will be more <br /> fully described in the permit itself. <br /> 1. The permit shall be limited to 25 ground based generators for the purpose of augmenting snow for <br /> enhanced snowpack and runoff during the time periods specified in the permit. Extensions of <br /> operational time periods can be requested in writing to the CWCB,but approval will be based on <br /> snowpack and avalanche suspension criteria and other conditions in the target area or downstream. <br /> 2. Said permit shall be for the period from November 1, 20t0 through March 31,2011 with <br /> conditional approval given for future operations for the five month period of November 1 through <br /> March 31 in the years 2010- 2011, 2011-2012, 2012-2013, 2013-2014, 2014-2015, 2015-2016, <br /> 2016-20171) 2017-2018, 2018-2019, and 2019-2020 based on adherence to: state statutes, <br /> coordination with the CWCB on suspension criteria, liability insurance requirements, and annual <br /> reporting to the CWCB. The permit will expire on March 31, 2020. <br /> 3. The person in control of the program must maintain a high level of coordination by consulting <br /> with and informing federal and state agencies, local governments, and private entities listed under <br /> the terms and conditions of the permit regarding operation of the program. <br /> 4. Snowpack snow water equivalent suspension criteria at SNOTEL sites will be posted daily on the <br /> internet by the NRCS Snow Survey Program in Colorado on a daily basis from December 15 <br /> through April 15 every year. This data will be used to suspend operations in time periods when <br /> snowpack exceeds levels that are within the natural variability of the local climate. SNOTEL sites <br /> that exceed suspension criteria in or near the target area will not suspend all operations within the <br /> permit but at a minimum will suspend operations at generator locations thought to reasonably be <br /> affecting areas where snowpack suspension criteria is exceeded. <br /> 5. The Permit Holder will coordinate with the CWCB and the Colorado Avalanche Information <br /> Center(LAIC), and the Colorado Department of Transportation in times of high and extreme <br /> avalanche hazard levels and will suspend operations at generator locations when they will be <br /> affecting the areas of concern in the name of health, environment, and public safety, as determined <br /> by the CAIC staff and specialized CAIC cloud seeding website. <br /> 6. The Permit Holder must prepare progress reports that include a detailed log of seeding operations, <br /> generators used, seeding rates, and daily durations of operations in Microsoft Excel spreadsheet <br /> format and submit them electronically. The applicant will develop a detailed end of year report on <br /> operations with an estimated evaluation of effectiveness. The annual report must be submitted no <br /> later than June 30th of any given year. The Permit Holder will maintain an Excel spreadsheet with <br /> the generator site locations with latitude and longitude data for every generator location and <br /> update it and submit it after every change in location. <br /> 7. The weather modification permit shall be further subject to such other terms and conditions as are <br /> set forth in the permit. In particular, funding for operations from the CWCB and external agencies <br /> outside of the CWCB will be contingent on strict adherence to permit requirements and prompt <br /> completion of annual reports. <br /> 8. The Permit Holder will cooperate with any CWCB or Project Sponsor requests to coordinate with <br /> and provide data for independent evaluations not conducted by WWC. <br /> 6 <br />
