The Commissioners noted that <br />the Resolutions set forth in this Minute will assist the United States and Mexico in their <br />efforts to obtain the most complete and satisfactory utilization of the waters of the <br />Colorado River and thereby contribute to the fulfillment of the objectives of the 1944 <br />Water Treaty. <br />The Commissioners further noted the discussions currently being carried out under <br />the framework of Commission Minute No. 317, dated June 17, 2010, entitled "Conceptual <br />Framework for U.S.- Mexico Discussions on Colorado River Cooperative Actions," and <br />they observed that in this context, cooperative actions on the Colorado River are being <br />discussed that minimize the impacts of potential Colorado River shortage conditions; <br />generate additional volumes of water using new sources by investing in infrastructure such <br />as desalinization facilities; conserve water through investments in a variety of current and <br />potential uses, including agriculture, among others; and envision the possibility of <br />permitting Mexico to use U.S. infrastructure to store water. These cooperative actions are <br />intended to benefit both countries and help them address and adapt to future water supply <br />challenges in the Colorado River Basin, including the potential long -term, adverse impacts <br />of climate change. <br />In this context, the Commissioners observed, consistent with the spirit of <br />cooperation reflected in the 1944 Water Treaty as well as Minute No. 317, the <br />appropriateness of providing for adjustment of the delivery schedules for waters allotted to <br />Mexico during the period from 2010 through 2013 in order to address immediately the <br />problems arising from the earthquake damage to Mexico's irrigation infrastructure, taking <br />into account evaporation losses associated with this change in delivery schedules and the <br />potential impact on the salinity differential between Imperial Dam and the Northerly <br />International Boundary, described in Resolution 1. a) of Minute No. 242, "Permanent and <br />Definitive Solution to the International Problem of the Salinity of the Colorado River," <br />dated August 30, 1973, while continuing in the meantime the discussions that are currently <br />underway through the Commission regarding cooperative opportunities on the Colorado <br />River and their implementation in the framework of Minute No. 317. <br />Based on the above, the Commissioners submit the following resolutions for the <br />approval of both Governments: <br />1. Taking into account the infrastructure damage caused by the April 2010 <br />earthquake in the Mexicali Valley, Baja California, and with the objective of <br />ensuring that, during the period from 2010 through 2013, only.those volumes of <br />water that Mexico can utilize are scheduled for delivery during said period, at <br />Mexico's request, the schedule for the annual delivery to Mexico of its allotment <br />
