<br />THIS CONTRACT, made chis day of , Natural Resources

<br />hereinafter referred to as the State, and 'z the Bauer Ldkes Water' Company,
<br />11747 Co. Rd. 41, Mancos, CO 81328,
<br />hereinaFter referred to as the contractor,
<br />WHEREAS, authority exists in the Law and Funds have been budgeted, appropriated and otherwise made
<br />available and a sufficient unencumbered balance thereof remains av ilable f r payment in Fund Number 4008 ,
<br />G(L Account Number 5268X , Contrac[ Encumbrance Number and
<br />ABL Account Num�,er 12680, Org. Unit 77
<br />WHEREAS, reyuired approval, clearance and coordination has been accomplished from and with appropriate
<br />agencirs;and
<br />WHEREAS, pursuant to the i, of section 37-60-119,
<br />Colorado Revised Statutes 197 d, the State is
<br />authorized to construct certai r pro'e ts for the benefit of
<br />the people of the State of Color ,�
<br />WHEREAS, the Bauer Lak��t pany has made application
<br />to the State for the improvement of its existing facility, such
<br />improvement of the facility is hereinafter someti�es referred to
<br />as the project; and
<br />WHEREAS, the Contractor is a mutual ditch cpmpany within the
<br />5tate of Colorado;
<br />NOW THEREFORE, it is hereby agreed that
<br />t. The Contractor shall have a feasibility report prepared
<br />and directed to the problem of improving the facilities of the
<br />Bauer No. 1 dam in accordance with a proposal for a oroject
<br />feasibility report prepared by the consulting engineering firm of
<br />Roach Engineering (the Consultant) and approved by the State,
<br />received on September 6, 1984, which proposal is attached hereto
<br />as Exhibit A and made a part of this contract.
<br />2, Fifteen (15) copies of the final report called for in
<br />this contract shall be furnished to the State not later than
<br />November 15, 1984, unless such time is extended by mutual
<br />agree�nent of the parties hereto in writing.
<br />3. As compensation for the services of the Contractor, the
<br />State shall pay to the Contractor the sum of Two Thousand Dollars
<br />($2,000) in the manner following:
<br />a. Sixty percent (60�), to wit, One Thousand Two Hundred
<br />Dollars ($1,200) of the total amount due in two (2)
<br />monthly installments of Six Hundred Dollars ($600) each,
<br />commencing on October 15, 1984.
<br />b. The remaining forty percent (40�), to wit,
<br />Eight Hundred Dollars ($800) within forty (40) days
<br />following receipt and acceptance of the written report

<br />4. The total cost of services to be rendered for the
<br />Contractor by the Consultant is Four Thousand Dollars ($4,000)
<br />and the Contractor shall pay the sum of Two Thousand Dolalrs
<br />($2,000).as agreed to by resolution dated August 24, 1984, which
<br />is hereby attached and made a part of this contract as Exhibit B;
<br />and in no event shall this payment be the liability of the State
<br />of Colorado.
