NOW THEREP'ORE, it is agceed that: <br />1. Considetation foc this amendment to the Oriqinal <br />Cont�act consists of the payments which shall be made pucsuant <br />to this amendment and the pcomises and aq�eements herein set <br />forth. This consideration shall constitute all final payments <br />due to the Contractor for the const�uction of the ptoject. <br />?.. This contcact amendment is a supplement to the <br />Oriyinal Contcact, attached heceto as Appendix A, which is by <br />refe�ence incorpocated hecein and made a pa�t heteof. All <br />terms, conditions and provisions of the Oriqinal contract, <br />unless specifically modified hecein, shall apply to this <br />contcact amendment as though they wece exp�essly cewtitten, <br />inco�po�ated and included herein. <br />3. The only modifications, altecations or changes in the <br />Oriqinal contcact shall be that Fxhibit C shall be revised as <br />shown on Appendix B. and pa�aq�aphs B.13., D.1., J., and N. <br />shall be revised to [ead as follows. <br />B. <br />13. Repay to the State the to cincipal sum of Eiqhty <br />Thousand Eiqht Hundted Fifty� s and Twenty-Two Cents <br />($80,851.22), which includes ect an amount and the <br />Two-Thousand-Dolla� (�2,000) sibi p =t amount, <br />toqeChec with inte[est at the �a erceRt (5$) per <br />annum, said repayment to be stant annual <br />installments of Six Thousan��r und�ed Eiqhty-Seven Dolla�s <br />and Sixty Cents ($6,487.60) ch, foc twenty (2Q) yeacs, as <br />shown in Appendix B, attached hereto and incocporated by <br />refe�ence heeein, which fi�st installment shall be due and <br />payable on the first day of the month next succeeding the month <br />in which the State determines that the pcoject has been <br />substantially completed, and yeacly theceafter until the entire <br />p�incipal sum shall have been paid. Said installment payments <br />shall be made payable to the Colorado Watec Consecvation Boacd, <br />payable at the offices of said Boa[d in Denver, Colorado. <br />D. The State aq�ees that it shall: <br />1. Loan to the Cont�actor foc the construction of the <br />project an amount not to exceed Seventy-Eight Thousand Eiqht <br />Hund�ed Fifty-One Dollacs and Twenty-Two Cents ($78,851.22). <br />Said Seventy-Eight Thousand Eight Hundred Fifty-One Dollars and <br />Twenty-Two Cents ($78.851.22) shall be made available to the <br />Cont�acto� in accordance with the followinq terms and <br />conditions: <br />a. Beqinninq with the monthly peciod commencinq June <br />28, 1989, and foc evecy month theceafteL until said <br />pcoject has been completed, the Contcactot shall <br />pcepare, with the assistance of the Consultant referred <br />to in pacagraph B.1. above, an estimate of the funds <br />requi[ed for project construction ducinq that month and <br />shall fo�ward said estimate to the State not less than <br />fifteen (15) days p�ior to the beqinning of such month. <br />b. Upon receipt and app�oval by the State of such <br />monthly estimate, the State will, within focty (40) <br />days f�om the ceceipt of such estimate, pay ovec to the <br />Contractoc the amount of the monthly estimate or such <br />poction theceof as has been approved by the State. <br />c.
