iii. Whether existing federal policies, regulations and laws affect or will be affected <br />by the RICD; <br />iv. Whether a reasonable means is to be utilized to use, divert, capture and control the <br />water for a RICD so as to minimize its call upon the river and avoid waste; [TU <br />has stated that this rule is improper] [Pueblo West has stated that adding <br />recirculation systems should be added to this sub - factor] <br />V. Whether a reasonable demand exists for the recreational activity in question as <br />determined by levels of current use and /or estimates of future use; <br />vi. Whether the application has appropriate limitations upon the time of day, days per <br />month, or seasons during which the RICD would be exercised; [The Upper <br />Gunnison River Water Conservancy District has stated that this rule should <br />be deleted or moved to Rule 7.a] <br />vii. The depth and flow rate of the proposed RICD; <br />viii. With what frequency and duration the requested amounts of water for the RICD <br />occur; <br />ix. Does the proposal include provisions for mandatory conversion of the RICD to a <br />recirculation system in the event such conversion is justified by the value of the <br />water otherwise routed to lower elevations by the RICD; and, [Suggested by <br />Pueblo West] <br />xvii. Is there a provision for reducing or canceling the RICD? [Suggested by Pueblo <br />West] <br />f. Pursuant to section 37- 92- 102(6)(b)(VI), an additional factor that is appropriate <br />for evaluation of RICD applications is whether the application meets the elements of the <br />definition of an RICD as found in section 37- 92- 103(10.3). This requires the amount <br />claimed to be the "minimum stream flow" and that it be for a "reasonable recreation <br />experience." The Board should consider the following factors in determining whether the <br />flows sought meet this definition: <br />
