PARTIES <br />This Grant Agreement (hereinafter called "Crrant") is entered into by and between City of Pueblo (hereinafter <br />called "Grantee"), and the STATE OF COLORADO acting by and through the Department of Natural <br />Resources, Colorado Water Conservation Board (hereinafter called the "State or CWCB"). <br />2. EFFECTIVE DATE AND NOTICE OF NONLIABILITY. <br />This Grant shall not be effective or enforceable until it is approved and signed by the Colorado State Controller <br />or designee (hereinafter called the "Effective Date"). The State shall not be liable to pay or reimburse Grantee <br />for any performance hereunder, including, but not limited to costs or expenses incurred, or be bound by any <br />provision hereof prior to the Effective Date, <br />3. RECITALS <br />A. Authority, Appropriation, And Approval <br />Authority for the agency entering into this Contract arises from Colorado Revised Statutes (CRS) 39-29- <br />109(2)(c), 37-75-102 and 37-75-104(2)(c) and Senate Bill 06-179 adopted by the 2006 General Assembly, <br />and a sufficient unencumbered balance thereof remains available for payment. Required approvals, <br />clearance and coordination have been accomplished from and with appropriate agencies. <br />B. Consideration <br />Page 1 of 15 <br />
