A. Measurement. The District shall install, maintain and operate such measuring <br />devices as determined by the Division Engineer as necessary to administer the change of <br />water rights approved herein. <br />B. Accounting. The District shall maintain and submit such accounting of the <br />operation of the Pleasant Valley Project Rights as determined by the Division Engineer is <br />necessary to administer the change of water rights approved herein. <br />C. Avoidance of Wilderness Area. The District shall not inundate any lands located <br />within the Sarvis Creek Wilderness Area with the construction and operation of the <br />Morrison Creek Reservoir. <br />D. Effect of changes. Applicant's analysis of the Pleasant Valley Project Rights <br />established that the water would be available for diversion every year. In addition, terms <br />and conditions have been considered to avoid any enlargement to the contemplated draft <br />of the Pleasant Valley Project Rights. Therefore, existing decreed junior rights located <br />downstream from the original points of diversion and storage shall not be required to by- <br />pass any of the amount determined to be legally and physically available as a result of <br />this upstream change in place of storage. <br />E. Physically and legally available. Any water diverted at Morrison Creek <br />Reservoir under the Pleasant Valley Project Rights must be physically and legally <br />available at the original points of diversion. <br />22. Retained Jurisdiction. The Court shall retain jurisdiction for reconsideration of the <br />change of water rights approved herein for a period of five years after Morrison Creek Reservoir <br />has been constructed and water delivered to Stagecoach Reservoir. The District shall give notice <br />to the Court, the Division Engineer, and all opposers of the initiation of such operation for any of <br />such decreed uses. <br />23. Fully Integrated System. As decreed in Case No. 0 1 CW41, the conditional water rights <br />decreed herein are individual components of Applicant's integrated water supply system. <br />Consequently, in subsequent diligence proceedings, work on any one feature of Applicant's <br />supply system as described in such Case No. OICW41 and as may be supplemented by court <br />decree in the future shall be considered in finding that reasonable diligence has been shown in <br />the development of water rights for all features of Applicant's water supply system, including the <br />Pleasant Valley Project Rights changed by this case. C.R.S. § 37-92-301(4)(b). <br />24. Water Matters.
