(6) Amount: 10,620 acre-feet out of 43,220 acre-feet conditionally decreed. <br />(7) Decreed Uses: Irrigation, domestic, stock watering, municipal, industrial <br />and power uses and appropriative rights of exchange and substitution, <br />augmentation and exchange for replacement purposes and all other augmentation <br />uses. <br />B. Pleasant Valley Feeder Canal: <br />(1) Previous Decrees: Case No. Civil Action 3926 as modified by decree <br />entered in Case No. W-946-76 and Case No. 0 1 CW41. <br />(2) Court: Routt County District Court and District Court for Water Division <br />No. 6, Colorado. <br />(3) Decreed Point of Diversion and Places of Storage: The Canal takes its <br />water from Walton Creek and McKinnis Creek: The first headgate and point of <br />diversion is located on the left bank of Walton Creek at a point whence the SW <br />Comer of Sec. 10, Township 5 N., Range 84 W. bears S. 55*41' West a distance <br />of 5112.6 feet. The second headgate is located on the left bank of McKinnis Creek <br />at a point whence the SW Comer of Sec. 16, Township 5 N., Range 84 W. bears <br />S. 73*22' West a distance of 7,576.6 feet. The Canal also has the same three <br />alternate storage locations as Pleasant Valley Reservoir described above, as <br />decreed in Case No. W-946-76. <br />(4) Source: Walton Creek and McKinnis Creek, tributaries to the Yampa <br />River. <br />(5) Appropriation Date: June 29, 1959, Priority No. 39, for irrigation, <br />domestic, stock watering, municipal, industrial and power uses (the "1959 <br />Pleasant Valley Feeder Canal Right"), and June 29, 2001 priority date for <br />augmentation and exchange for replacement purposes and all other augmentation <br />uses as decreed in Case No. 0 1 CW41, District Court, Water Division 6 (the "2001 <br />Pleasant Valley Feeder Canal Right"). <br />(6) Amount: 300 c.fs., conditional. <br />(7) Decreed Uses: Irrigation, domestic, stock watering, municipal, industrial <br />and power uses and appropriative rights of exchange and substitution, <br />augmentation and exchange for replacement purposes and all other augmentation <br />uses. <br />CASE NO. 07CW61 <br />FINDINGS OF FACT, CONCLUSIONS OF LAW, <br />AND JUDGMENT AND DECREE <br />PAGE 5 <br />
