Page 2 <br />Appendix 2 <br />The City of Durango Community Development Department administers the City Flood <br />Ordinance of the City. The flood plain regulations require the application for a flood <br />plain permit where construction will occur within the areas of special flood hazard <br />identified by the Federal Emergency Management Agency (FEMA). Encroachments into <br />the floodway are prohibited unless certified by a state registered professional engineer <br />demonstrating that the encroachments will not result in any increase in flood levels <br />during the occurrence of the base flood discharge. <br />The Community Development Department will review an application filed for the <br />boating park upon completion of construction plans to assure compliance with the <br />regulations. <br />Work within the river will require that the City apply for a 404 Permit from the U.S. <br />Army Corps of Engineers. The City of Durango has previously made changes to the <br />boulder locations within the Animas River in the Smelter Rapids area and has secured <br />permission from the Corps through a nationwide permit. The City and its consultants <br />have met on several occasions with representatives of the Corps of Engineers to discuss <br />the proposed boating park and to describe proposed features within the park and <br />environmental concerns relative to the park and construction methods. No final <br />determination of the Corps will be made until an application including construction <br />drawings is filed, however based on previous approvals and discussions with the Corps, <br />approval of a 404 Permit can reasonably be expected. <br />Otha J.
