Depending <br />on certain outstanding tegal issues, the Vidler rights may be diverted and credited during <br />a period from May 15 to as late as October I5. Under the decree in Case No. 84CW716, <br />however, the period of use for the subject lt� acre-feet of his#orical use credit is <br />effectively limited to the period afMay 15 to September 15. The decree also includes a <br />daily maximum diversion of 0.8b4 cfs. <br />Because the Vid[er rights are for ini�ation season use anly, year-round use will require <br />storage of a portion of the rights during the irrigation season for subsequent release <br />during the non-irrigation season. <br />Swans Nest Reservoir No. 1 <br /> I' Under the decree in Case No_ 84CW716, the Swans Nest Reservoir Na. 1 is decreed for <br />storage of up to 13.9 acre-feet, primarity through exchange of the Vidler Rights, and is <br />� proposed for release of augmentation water. The proposed location af the reservoir is in <br />portions of Sections 7, 8, 17 and 18 of Township 6 South, Range 77 West of the 6`� P.M. <br />along the Swan River. The decree does not specificalty claim a new storage right for the <br />� reservoir, but does specifically discuss the methods of release or augmentation of any <br />associated out-of-priority evaporation depletiQns. The subsequent decree in Case No. <br />87CW21 b pravides for DiIlon Reservoir to be used as an additional place of storage for <br />� the Vidler augmentatian rights. <br />Because of the availability of alternative storage under the Dillon storage agreement, the <br />� potential construction and permitting casts for a new reservair, liznited land available <br />upon which ta construct the reservoir, and potentiai evaparatian losses which could be <br />significant in relation to other District consumptive uses, future development of the <br />� Swans Nest Reservoir No. 1 was not considered as a likely component of the District <br />water supp[y operations. <br />� Dillon Reservoir Storage A.greement <br />Under the decree in Case No. 87CW216 and an agreement dated November 8, 1990 <br />� between the City and County of Denver and Swan's Nest Metropolitan District, Swan's <br />Nest has been allotted 6 acre-feet for storage af its Vidler rights. This 6 acre-foat <br />ailotment is part of a total of l00 acre-feet of storage space in Dillan Reservoir made <br />� available to Summit County by Denver. Under the agreement, Swan's Nest rr►ust dedicate <br />28.5 percent of any Vidler water stored in Dillan Reservoir as a storage charge. This <br />means that for ea.ch 1.0 acre-foat of augmentation water neeried for nan-inigation season <br />� releases, 1.4 acre-feet would need to be delivered into Dillon Reservoir to offset the <br />storage chaxge. The availability ofstorage under this agreement allows for the year-round <br />operatian of the Swan's Nest wells under the augmentation plan_ <br />� Master Water Lease <br />This March 11, 1997 lease between Breckenridge Meadows Development Company and <br />� Swan's Nest MetrapoIitan District reserves a f�rst right of first use for Swan's Nest Well <br />� <br />
