Description of Water Rights�
Ten (10) consumptive acre-feet of water per year out of a total of 36i consumptive acre-feet, and
0.864 c.f.s. out of a tata.i maximum diversion rate of 31.22 c.f,s., decreed by the District Co�rt in
and for Water Division No. 5(the "Water Court"), in Case No. W-217, as being historically
attributable to the following described water rights;
(a} Itice Ditch, decreed for 4.50 c.f.s. with a May 3, 1893 appropriation date arrd a March 2,
1910 adjudicatian date. The originally decreed headgate of the Rice Ditch is located on
the left (sQUth} bank of the Snake River in the NW 1/4 SE 1/4 af Section 22, Township S
South, Range 77 West, 6th P.M.;
(b} Socla Creek Ditch, decreed far 2.72 c.f.s. with a July 1, 1900 appropriation date and a
March 2, 1452 adjudication date. The originally decreed headgate of the Soda Creek
Ditch is located on the right {east} bank af the Sada Creek at a point whence the South
quarter corner of Section 27, Township S South, Range 77 West, 6th P.M., bears South
10°15' East a distance of 940 feet;
(c) Phillips Ditch, decreed for 4.00 c.f.s. with a June 1, 19Q4 appropriation date and a Mazch
2, 1910 adjudica�ion date. The originally decreed headgate of the Phillips Ditch is
located on the left (west) hank of the Keystone Czeek in the SW 1I4 SW 1/4 af Section
l4, Township 5 South, Range 77 West, 6th P.M.;
(ti) Rice Ditch - Riley Enlargement, decreed for 1Q.00 c.f.s. with a July 5, 1914 appropriafion
date and an October 26, 1937 adjudication date. The originally decreed headgate of the
Riley Enlargement is located on the left (south} bank of the Snake River at a point
wh�nce the SW corner of Section 22, Township 5 South, Range 77 West, 6th P.M., bears
South 54°46' West a distance of 3845 feet; and
{e) Rice Ditch - Rice Enlargement, decreed for 10.00 c.f.s_ with a July 5, 1914 appropxiation
date and a March 1�, 1952 adjudication date. The origina.11y decreed headgate of the
Rice Enlargement is the same as the R.ice Ditch - Riley Enlargement,
as said water rights were changed by the Water Court in: the Case Nos. W-217 and W-2110, (aIl
the foregoing hereinafter called the "consumptive water right"),
together with six acre-feet per year af the 25 acre-feet per year of augmentation water to be
released to the Blue River frozn Dillon Reservoir (the "Dillan Storage Water"} pursuant to
paragraph 6(b) of the Agreement dated September I S, 19$5 between the City and County of
Denver acting by and �hrough its Board af Water Commissioners and the Board of County
Comxnissioners of Suxnmit County, Colorada ("the County"}, and the Agreement dated
November 8, I990 between the City and County of Denver actir:g by and through its Board of
