Durango Exhibit 1 <br />RESOLUTION R- 2006 -12 <br />A RESOLOXION AUTHORTZTNG TTTE APPROPRIATION OF WATER FOR A <br />RECREATIONAL IN- CHANNEL DIVEMION <br />WHFRE.AS, the Animas River is a vital element of the Durango community; and <br />WHKRYAS, the presence of this river in the center of the City of Durango ( "City") and the <br />recreational opportunities it provides, contributes substantially to the health and wclfhrc of tic local <br />economy and the area quality of life; and <br />WHEREAS, five in- chamiel diversion structures have been recommended for construction within <br />the stream channel of the Animas River; and <br />WHEIMAS, these proposed structrrus will divert, capture and control water to concentrate and <br />direct the flow of the Animas River to create features that enhance the recreational use of the river <br />for kavaking, rafting, tubing and other boating activities; and <br />WHEREAS, the City has assumed the responsibility and desires to obtain the necessary water rights <br />to ensure that the recreational in- channel diversion structures will operate as designed acid <br />accomplish the intended benefits; and <br />WHYRFAS, the greater the flows of the Animas River at the in- chatmeI diversion structures, the <br />greater die beneficial tcae and the greater the resultant economic benefit; and <br />WHEREAS, the City has engaged in an extensive analysis of the minimum amount of water <br />necessary to create a reasonable recreational experience for the intended use of the recreational in- <br />channel diversion structures; and <br />WHEREAS. the minimum amountef water necessary to create a reasonable recreation experience <br />in and on the water varies depending on the time of year and the available flows; and <br />WHEREAS, rite minimum amount of water necessary to create a reasonabic recreation experience <br />for the intended recreation use of the Animas River in- channel diversion structures during various <br />periods of tic year and tlic various structures are as follows (hereinafter die "RICD Flow Roues "): <br />
