3. State facts why application for water rights should not be granted or why it
should be granted only in part or on certain conditions:
a. The Applicant is seeking approval of RICD water rights for a stretch of the
Animas River located within the vicinity of the City of Durango. The amounts sought
may not be a beneficial use of water because the amounts may not be for the
minimum amounts necessary for a reasonable recreation experience.
b. The Applicant must be held to strict proof as to its claim that it is diverting the
water claimed in its application.
C. The Applicant must be held to strict proof that it is seeking a water right that is a
legally cognizable beneficial use of that water.
