Name of ditch or structure: As more fully described in the application. <br />3. State facts why application for water rights should not be granted or why it <br />should be granted only in part or on certain conditions: <br />a. The Applicant is seeking approval of RICD water rights for a stretch of the <br />Animas River located within the vicinity of the City of Durango. The amounts sought <br />may not be a beneficial use of water because the amounts may not be for the <br />minimum amounts necessary for a reasonable recreation experience. <br />b. The Applicant must be held to strict proof as to its claim that it is diverting the <br />water claimed in its application. <br />C. The Applicant must be held to strict proof that it is seeking a water right that is a <br />legally cognizable beneficial use of that water. <br />
