7. Required Findings <br />The board io required (omoko certain factual findings relative io each G]CD application. 8S7- <br />92-102(6) C.R.S. The statutory defiukiouo[RIC[) requires that the applicant claim only the <br />ouioizouu) abeuno Oovv, that the flow would be used for n reasonable recreation cxpuricuoc in and <br />on the water, and that the flow be diverted, captured, controlled,. and placed to beneficial use. <br />The required findings on factors are: <br />u. Whether the adjudication and ndnuiuiubo1iou of the 8JC[}, in the uo)num6n claimed, would <br />impair the ability of Colorado bofully develop and place ioconsumptive beneficial use its <br />compact entitlements. The board, in making this finding, may consider, but is not limited <br />to, the following: <br />i. The amount and location of rem aining ' unapp 'atedcompoct entitlement waters <br />in the basin in question and u1 the BJ[[] point ofdiversion; <br />ii. The proximity of the R]C[)tuthe siu1c line; <br />iii. The proximity ofthe RJC[)to suitable upstream points of diversion or storage <br />vvhidb may be utilized by those who would place the water 10 consumptive <br />beneficial use; <br />iv. The existence of suitable downstream points of diversion o, storage for <br />consumptive beneficial uses before the water leaves the state; <br />V. Exchange opportunities within the state that may be adversely impacted by the <br />existence of the Ql[I); <br />vi. Whether the basin ioovo,-upprophatrd� <br />vii. The effect on other decreed, existing undecreed, or reasonably foreseeable uses of <br />the amount of water claimed; <br />viii. Whether uRI[l) shields waters from ocnnsucuptive use that would otherwise be <br />available under o particular compact, <br />ix. Whether beneficial consumptive water use opportunities upstream from the <br />claimed R]C[)would further develop Colorado's compact entitlements and would <br />bs i hYnyphoau(`omoucbtlbrnbeumDo*urnouuts;ond, <br />X. What provisions io the application are proposed for reducing orcanceling the <br />FQCD? <br />b. Whether the RICD appropriation is for nu appropriate reach of stream for the intended <br />use.
