L. 566 Project
On July 7, 1964 1 wrote to you on the abi
matter wherein I outlined my interpretation of the
poration of the Paradox Valley Canal and Reservoir
posed sponsor of the project. The purpose of this
briefly and as simply as possible summarize one of
features of that memorandum,
eve subject
Articles of Incor-
Company, the pro -
memorandum is to
the salient
The water rights which Class I and Class Il own are fixed
by the Articles. it might help us all in our thinking if we con -
sider Class I and Class II stock as direct .flog rights on the
stream, which are valid only during the irrigation season (Class I -
From April 1 to October 15 and Class II -* From May 1 to October l).
Class III stock entitles the ottmers thereof to store water in the
reservoir. This water will normally be stored during the non -
irrigation season as the stream is ordinarily depleted by direct
Mow rights during the irrigation season.
The Articles specifically provide that neither Class I
nor Class 11 stock can be assessed For or share in enlargements of
Buckeye Reservoir. only Class III stockholders can be assessed for
and enjoy the benefits of the enlarged reservoir. it might again
help us all in our thinking if we consider that part of the en-
larged reservoir as a separate reservoir company owned by the Class
III stockholders.
D11H: mm
