SECTION 13. I thin six 1 6) mon ths after enactment hereof every <br />owner of existing reservoirs or deans used to impound any water whatso- <br />ever for stock watering purpose's, shall notify the State Engineer in <br />writing on forms prepared by the State Engineer, of the name of such <br />dam or reservoir,ithe general location thereof with reference to <br />section, township and range-, the capacity and height of dam and date <br />of the completion thereof'. All such stock watering reservoirs or dams <br />constructed before the effective date of this Act, and reported to the <br />State Engineer'as herein provided; shall be assigned a priority number <br />according to the date of completion as shown by the notice, specified <br />in this paragraph; to the .State Engineer: In the event of doubt as to <br />the.date of completion or because of any controversy with respect there- <br />to, the State Engineer may in his discretion require further and satis- <br />factory proof of such date of completion: _} <br />SECTION 14 No reservoir for stock watering purposes having a <br />capacity of,more than ten '(10) acre feet or�havirig a dam more than <br />fifteen (15) feet iii vertical height from the bottom of the channel to <br />the bottom of the' spillway, shall hereafter be constructed in this state <br />except that the plans and specifications for the saim shall have first <br />- -been approved by the.State Engineer and filed in his office; and the <br />State Engineer shall act as consulting engineer during the construction" r <br />thereof, and shall have - aa thority to require the material used and the { <br />work of construction to be done to his satisfaction; and no work shall �. <br />be deemed complete under the' provisions, of this law until the State � 1 <br />Engineer shall furnish to the owners of such structures a Written' state � <br />went of the work of construction and the full completion thereof, to- <br />, gather with his acceptance of the same, which statement shall_ specify the � <br />dimensions of such dam and oapacity of such reservoir; <br />SECTION 15i The owner of any dam,or reservoir f�iling,to comply <br />With the provisions of this Act shall be subject to a penalty of not <br />more than twenty -five dollars 025.•00) nor less than five dollars. <br />('5600) to be recovered and disposed of as pr oP ded in Section 92, <br />Chapter 90, 1935 Colorado Statutes Annotated: <br />5 <br />SECTION 16. 'All acts or party of acts inconsistent or in conflict <br />herewith are hereby repealed: <br />SECTION 17:" The General Assembly hereby finds,' determines and de- <br />clares this Act to be necessary for the immediate preservation of the <br />public health and safety. <br />SECTION 18. In the opinion of the General Assembly an energency <br />exists; therefore; this Act shall take effect and be in force from and <br />after its passage.- <br />"4 <br />
