Legal description of the stream segment through which an instream flow is claimed <br />a. The natural stream channel from the confluence of the North Fork <br />Escalante Creek at latitude 38° 37' 57" N and longitude 108° 23' <br />30" W as the upstream terminus and extending to the headgate of <br />Captain H.A. Smith at latitude 38° 40'47" N and longitude 108 18' <br />41" Was the downstream terminus, being a distance of <br />approximately 6.4 miles, This segment can be located on the <br />Escalante Forks and Kelso Point U.S.G.S. quadrangles. <br />b. For administrative purposes only: <br />Upper Terminus = NE NE_. S2 T50N R14W NMPM <br />215' West of East Section Line 590' South of North Section Line <br />UTM 42 81 461 N 13 2 04 751 E <br />Lower Terminus = SE SW S 15 T5 IN R13 W NMPM <br />1446' East of West Section Line 326' North of South Section Line <br />UTM 42 86 429N 13 2 11 941 E <br />5. Use of the water: <br />Instream flow to preserve the natural environment to a reasonable degree. <br />6. Date of initiation of appropriation: <br />January 25, 2005. <br />7. The water was first applied to the above beneficial use on January 25, 2405, <br />by the action of the Colorado Water Conservation Board under the provisions of C.R.S. <br />§ § 37- 92- 102(3) and 37- 92- 103(3), (4) and (10). <br />8. Amount of water claimed (ABSOLUTE): Instream flow of 4 cfs (Mar. 1— <br />Mar. 31), 8.2 cfs (Apr. 1 - June 14), 4 cfs (June 15 - July 31), and 1.5 cfs (Aug. 1 — Feb. <br />28). <br />THE WATER REFEREE RULES: <br />The application is granted and a decree (ABSOLUTE) in the amount of 4.00 cfs (Mar. 1 <br />— Mar. 31), 8.20 cfs (Apr. I - June 14), 4.00 cfs (June 15 - July 31), and 1. 50 cfs (Aug. 1 <br />— Feb. 28) is hereby entered to preserve the natural environment to a reasonable degree in <br />the reach of Escalante Creek between the upstream and downstream points described in <br />paragraph 4 above. The appropriation date for this water right is January 25, 2005. <br />
