12 <br />1 ed States Supreme Court has issued or may revise from <br />2 time to time for allocation of the waters of the North <br />3 Platte River and its tributaries. <br />4 (b) WATER RIGHTS. —(1) Nothing in this Act or any <br />5 other Act of Congress shall constitute or be construed to <br />6 <br />constitute either an express or implied reservation of water <br />7 <br />or water rights arising from wilderness designation for the <br />8 <br />lands designated as wilderness by this Act. <br />9 <br />(2) The United States may acquire such water rights <br />10 <br />as it deems necessary to carry out its responsibilities on <br />11 <br />any lands designated as wilderness by this Act pursuant <br />12 <br />to the substantive and procedural requirements of the <br />13 <br />State of Colorado: Provided, That, nothing in this Act <br />14 <br />shall be construed to authorize the use of eminent domain <br />15 <br />to acquire water rights. <br />16 <br />(3) Notwithstanding any other provisions of law, no <br />17 <br />officer of the United States shall authorize or issue a per - <br />18 <br />mit for the development of a new water resource facility <br />19 <br />within the lands designated as wilderness by this Act: Pro - <br />20 <br />vided, That nothing in this title shall affect irrigation, <br />21 <br />pumping and transmission facilities and water facilities in <br />22 <br />existence within the boundaries of the wilderness, or limit <br />23 <br />operation, maintenance, repair, modification or replace - <br />24 <br />ment of existing facilities as provided in paragraph (f) of <br />25 <br />this section. <br />S 10291S <br />
