0
Existing Water Right Information
Staff has analyzed the water rights tabulation and consulted with the Division Engineer Office
(DEO) to identify any potential water availability problems. There is one decreed surface
diversion located within the proposed instream flow water right, the Taylor Ditch, located near
the confluence with the Arkansas River. Additional surface diversions located on tributaries to
Badger Creek include the Paul Walton Ditch, the Craig Ditch and Allen Ditch Nos. 1 and 2.
Based on this analysis, staff has determined that water is available for appropriation on Badger
Creek between the spring complex located in the SW /4 NE /4, Section 24, T51N R10E and the
confluence with the Arkansas River, to preserve the natural environment to a reasonable degree
without limiting or foreclosing the exercise of valid existing water rights.
CWCB Staff's Instream Flow Recommendation
Staff recommends the Board form its intent to appropriate on the following stream reach:
Segment Springs near Antelope Gulch to Confluence with Arkansas
River
Upper Terminus: Springs near Antelope Gulch
(Latitude 38° 39' 13.9 "N) (Longitude 105° 48' 52.5 "W)
UTM = 4278683.9N 429119.3E
SW NE S24 T5 1N R10E NM PM
1041' West of East Section Line; 1650' South of North Section Line
Lower Terminus: Confluence with Arkansas River
(Latitude 38° 27' 54.6 "N) (Longitude 105° 51' 40.9 "W)
UTM = 4257780.6N 424852.1E
SE SE S28 T49N R10E NM PM
39' West of East Section Line; 756' North of South Section Line
Watershed: Arkansas Headwaters (HUC#: 1102000 1)
Counties: Fremont
Length: 16.0 miles
USGS Quad(s): Gribbles Park, Jack Hall Mountain, Howard
Flow Recommendation (Enlargement): 2.5 cfs (April 1 to August 31)
2.0 cfs (September 1 to October 31)
