decreed water rights for the course's stream flow requirements, <br />Applicant filed an application for a RICD in March 2002. <br />In its RICD filing, Applicant claimed variable, daytime <br />stream flows ranging from 270 to 1500 cubic feet per second <br />(cfs). These variable flows totaled approximately 157,000 acre <br />feet annually — over 41 percent of the Gunnison River's <br />available stream flow. Applicant claimed the highest flows only <br />during the last two weeks of June and the first two weeks of <br />July, when water supplies were ample. The course was designed <br />with diversion structures incorporating both low flow and high <br />flow channels in order to maximize use of the whitewater course <br />by all skill levels throughout the recreational boating season, <br />even as stream flows decreased. Applicant claimed no water for <br />the months October through April. <br />The CWCB reviewed Applicant's claimed RICD, accepting both <br />oral and written comments from Applicant and other interested <br />parties. Following deliberations., the CWCB issued written <br />findings and recommendations to the water court.
