Legal description of the stream segment through which an instream flow is <br />claimed: <br />a. The natural stream channel beginning at the State Land Board boundary <br />at latitude 40° 55' 53 "N and longitude 108° 58' 08 "W as the upstream <br />terminus and extending to the Colorado -Utah state line at latitude 40° <br />.54' 41 "N and longitude 109° 02' 57 "W as the downstream terminus, <br />being a distance of approximately 5.2 miles. This segment can be <br />located on the Beaver Basin and Willow Creek Butte U.S.G.S. <br />quadrangle. <br />b. For administrative purposes only: <br />Upper Terminus = <br />NW NW S10 TI IN RI 03W 6"PM <br />1120' East of the West Section Line, 1242' South of the North Section Line <br />UTM North: 4538743.4 UTM East: 165822.3 <br />Lower Terminus = <br />NW SW S13 TI IN R104W 6 th Pm <br />0' East of the West Section Line, 2021' North of the South Section Line <br />UTM North: 4536837.0 UTM East: 158958.1 <br />5. Use of the water: <br />Instream flow to preserve the natural environment to a reasonable degree. <br />6. Date of initiation of appropriation: December 31, 2007. <br />7. The water was first applied to the above beneficial use on December 31, <br />2007, by the action of the Colorado Water Conservation Board under the provisions of <br />C.R.S. § § 37- 92- 102(3) and 37- 92- 103(3), (4) and (10). <br />8. Amount of water claimed (ABSOLUTE): Instream flow of 1.1 cfs <br />(November 1 — April 30), and 1.8 cfs (May 1 — October 31). <br />THE WATER REFEREE RULES: <br />The application is granted and a decree (ABSOLUTE) in the amount of Instream <br />flow of 1.1 cfs (November 1 —April 30), and 1.8 cfs (May 1 — October 31) is hereby <br />entered to preserve the natural environment to a reasonable degree in the reach of Beaver <br />
