2. The name of stream involved: <br />Elkhead Creek (instream flow) <br />The source of the water is: Elkhead Creek of the Yampa River <br />4. Legal description of the stream segment through which an instream flow is <br />claimed: <br />a. The natural stream channel from its confluence with Torso Creek at <br />latitude 40° 46' 23" N and longitude 107° 07' 50" W as the upstream <br />terminus and extending to the inlet of the proposed California Park <br />Reservoir at latitude 40° 45' 4" N and longitude 107° 07' 60" W as the <br />downstream terminus, being a distance of approximately 2.2 miles. <br />This segment can be located on the Bears Ears Peaks and Quaker <br />Mountain U.S.G.S. quadrangles. <br />b. For administrative purposes only: <br />Upper Terminus = <br />UTM 4515748.458N 320197.162E <br />NW '/ NE %, S3, T9N, R87W, 6th PM <br />1477 feet W of the E section line, 1074 feet S of the N section line <br />Lower Terminus = <br />UTM 4513311.024N 319905.456E <br />NW t / SE % , S 10, T9N, R87W, 6' PM <br />2219 feet W of the E section line, 1421 feet N of the S section line <br />Use of the water: <br />Instream flow to preserve the natural environment to a reasonable degree. <br />Date of initiation of appropriation: <br />January 25, 2006. <br />The water was first applied to the above beneficial use on January 25, 2006, <br />by the action of the Colorado Water Conservation Board under the <br />provisions of C.R.S. § § 37 -92- 102(3) and 37- 92- 103(3), (4) and (10). <br />Amount of water claimed (ABSOLUTE): Instream flow of 3.9 cfs (April 1 <br />— July 31) and 1. 75 cfs (August 1 — March 31). <br />THE WATER REFEREE RULES: <br />The application is granted and a decree (ABSOLUTE) in the amount of Instream <br />flow 3.9 cfs (April 1 — July 31) and 1.75 cfs (August 1 — March 31) is hereby entered to <br />preserve the natural environment to a reasonable degree in the reach of Elkhead Creek <br />
