Legal description of the stream segment through which an instream flow is claimed: a. The natural stream channel from the outlet of Stratton Reservoir at latitude 38° 46' 44.24 "N and longitude 104° 59' 17.55 "W as the upstream terminus and extending to above North Cheyenne Creek Pipeline at latitude 38° 47' 12.26 "N and longitude 104 54' 52.31 "W as the downstream terminus, being a distance of approximately 7.5 miles. This segment can be located on the Manitou Springs SW, SE, and Colorado Springs SW U.S.G.S. quadrangles. b. For administrative purposes only: Upper Terminus = SE NW S3 TI 5S R68W 6"' PM 1430' South of the North Section Line 1700' East of the West Section Line UTM North: 4292247.6 UTM East: 501024.1 Lower Terminus = NE SW S32 T14S R67W 6`'' PM 1.700' North of the South Section Line 2065' East of the West Section Line UTM North: 4293114.6 UTM East: 507423.1 5. Use of the water: Instream flow to preserve the natural environment to a reasonable degree. 6. Date of initiation of appropriation: January 23, 2008 7. The water was first applied to the above beneficial use on January 23, 2008, by the action of the Colorado Water Conservation Board under the provisions of C.R.S. § § 37- 92- 102(3) and 37 -92- 103(3), (4) and (10). 8. Amount of water claimed (ABSOLUTE): Instream flow of 2.5 efs (April 1 — April 30), 3.5 cfs (May 1- October 15) and 1.0 cfs (October 16 — March 31). THE WATER REFEREE RULES: The application is granted and a decree (ABSOLUTE) in the amount of flow of 2.5 cfs (April 1 — April 30), 3.5 cfs (May 1.- October 15) and 1.0 cfs (October 16 —March 31) is hereby entered to preserve the natural environment to a reasonable degree in the reach of North Cheyenne Creek between the upstream and downstream terminus points
