Legal description of the stream segment through which an instream flow is <br />claimed: <br />a. The natural stream channel from the outlet of Stratton Reservoir at latitude <br />38° 46' 44.24 "N and longitude 104° 59' 17.55 "W as the upstream terminus <br />and extending to above North Cheyenne Creek Pipeline at latitude 38° 47' <br />12.26 "N and longitude 104 54' 52.31 "W as the downstream terminus, being <br />a distance of approximately 7.5 miles. This segment can be located on the <br />Manitou Springs SW, SE, and Colorado Springs SW U.S.G.S. quadrangles. <br />b. The water was first applied to the above beneficial use on January 23, 2008, <br />by the action of the Colorado Water Conservation Board under the provisions of C.R.S. <br />§ § 37- 92- 102(3) and 37 -92- 103(3), (4) and (10). <br />8. Amount of water claimed (ABSOLUTE): Instream flow of 2.5 efs (April 1 <br />— April 30), 3.5 cfs (May 1- October 15) and 1.0 cfs (October 16 — March 31). <br />THE WATER REFEREE RULES: <br />The application is granted and a decree (ABSOLUTE) in the amount of flow of <br />2.5 cfs (April 1 — April 30), 3.5 cfs (May 1.- October 15) and 1.0 cfs (October 16 —March <br />31) is hereby entered to preserve the natural environment to a reasonable degree in the <br />reach of North Cheyenne Creek between the upstream and downstream terminus points <br />
