recommendations to the Water Court as to whether the application should be granted, granted <br />with conditions, or denied. <br />The proposed Rules include basic information such as title, basis and purpose, and <br />underlying statutory authority; define important terms; clarify CWCB staff responsibilities; <br />establish procedures for implementation of CWCB responsibilities under Senate Bill 01 -216; and <br />set forth factors the CWCB may consider in making the required findings and recommendation <br />to the Water Court. <br />EFFECTIVE DATE <br />The Rules concerning recreational in- channel diversions will become effective on <br />December 31, 2001. <br />SPECIFIC STATUTORY AUTHORITY <br />The statutory authority for the promulgation of the rules concerning Recreational In- <br />Channel Diversions is found at section 37 -92 -102, C.R.S.
