recommendations to the Water Court as to whether the application should be granted, granted
with conditions, or denied.
The proposed Rules include basic information such as title, basis and purpose, and
underlying statutory authority; define important terms; clarify CWCB staff responsibilities;
establish procedures for implementation of CWCB responsibilities under Senate Bill 01 -216; and
set forth factors the CWCB may consider in making the required findings and recommendation
to the Water Court.
EFFECTIVE DATE
The Rules concerning recreational in- channel diversions will become effective on
December 31, 2001.
SPECIFIC STATUTORY AUTHORITY
The statutory authority for the promulgation of the rules concerning Recreational In-
Channel Diversions is found at section 37 -92 -102, C.R.S. (2001).
