Walcher <br />Executive Director <br />Rod Kuharich <br />CWCB Director <br />Dan McAuliffe <br />Deputy Director <br />Attached please find a summary of the formal comments received on or before October 17, 2001 regarding the <br />version of the Proposed Rules Concerning Recreational In- Channel Diversions as published in the Colorado <br />Register on October 10, 2001. We received nine letters on or before the October 17, 2001 deadline for <br />submission of formal comment and several additional letters after that date. This document also includes <br />additional comments from the Staff responding to comments received on or before to October 17, 2001. <br />Guide to the Summary Document <br />Preceding the Rules is a list of abbreviations that appears in the Summary Document. The Rules as submitted to <br />the Secretary of State on September 27, 2001 are copied into the Summary Document. The Rule titles appear as <br />BOLD CAPITAL LETTERS and the text of the rules appears as bold italic text. The Staff's recommendations are <br />reflected in the rules in redline form (strikeout for deletions and underline for additions). A description of the <br />Staff recommendation and an explanation for the Staff recommendation are entered in italic text and preceded <br />by a darkened arrow (10). <br />All comments are paraphrased and inserted in plain text below the Staff Recommendation for the appropriate <br />Rule, section and subsection proceeded by an empty arrow (b). The entity submitting the comment is identified <br />with a parenthetical reference after the comment. Please note that the comments are paraphrased and as such do <br />not contain the exact text of the comment letters. For original wording, please refer to the letter submitted by <br />the commenting party. Moreover, please refer to the individual letters received after October 17 for their <br />individual comments as those comments are not reflected in the Staff's Summary Document. <br />General comments (also paraphrased) are included at the end of the document as are comments regarding the <br />Statement of Basis and Purpose. A redline version of the Statement of Basis and Purpose follows the Summary <br />Document.
