0 0 <br />agencies, boards, officials, and employees is controlled and <br />limited by the provisions of § 24 -10 -101, et seq., C.R.S., as <br />amended, and § 24 -30 -1501, et seq., C.R.S., as amended. Any <br />provisions of this Lease and Sublease, whether or not incorporated <br />herein by reference, shall be controlled, limited, and otherwise <br />modified so as to limit any liability of Parks and the CWCB to the <br />above -cited laws. <br />11. Lessee Liability Exposure Any liability of the <br />Service and the United States for claims for injuries to persons or <br />property arising out of the alleged negligence of the Service and <br />the United States shall be determined in accordance with and <br />subject to the Federal Tort Claims Act. <br />12. Hold Harmless The CWCB shall hold Parks harmless from <br />and against all claims, demands, and causes of action on account of <br />property damage, personal injury, or death resulting from the <br />control, carriage, use, handling, or distribution of releases from <br />Steamboat Lake delivered to the CWCB, provided that releases are <br />delivered by Parks to the CWCB in a safe and reasonable manner. <br />Parks shall hold the CWCB harmless from and against all claims, <br />demands, and causes of action on account of property damage, <br />personal injury, or death resulting from or in any manner connected <br />with the storage of water in or the operation and maintenance of <br />Steamboat Lake. <br />13. Surplus Water If the Service, through the CWCB, does <br />not request release of all water leased in a particular year <br />(October 1 - September 30), the leased water that is not released <br />shall not be carried over into the next year and will not be <br />available for future use by the Service or the CWCB. <br />14. Other Obligations to Provide Water Parks will provide <br />the Service with written notice of all leases or other agreements <br />to provide water or storage of more than 50 acre -feet of water from <br />Steamboat Lake pursuant to the decree in Case No. 90CW01 that are <br />executed subsequent to the date of this Lease and Sublease. Such <br />leases will be treated by Parks as junior to this Lease and <br />Sublease. In the event there is insufficient water available under <br />the decree in Case No. 90CW01 to satisfy all subsequent leases of <br />Steamboat Lake water, Parks shall fulfill its obligations under <br />this Lease and Sublease prior to releasing water pursuant to any <br />such junior leases. <br />15. Availability of Water Parks shall use its best efforts <br />to ensure that sufficient water is available at all times for <br />release to the CWCB, pursuant to requests from the Service, <br />pursuant to the terms of this Lease and Sublease. <br />16. Termination This Lease and Sublease may be terminated <br />as follows: <br />
