NOTICE OF APPEAL
Appellants, the State Engineer, Division Engineer for Water Division 5 and the Colorado
Water Conservation Board (collectively "State "), through the Attorney General for the State
of Colorado and the undersigned Assistant Attorney General, set forth the following Notice
of Appeal pursuant to C.A.R. 3 (d):
I. BRIEF DESCRIPTION OF THE NATURE OF THE CASE.
A. General statement of the nature of the controversy.
This appeal involves a water matter tried before the Water Court for Water Division 5.
Applicant /Appellee, Town of Breckenridge sought conditional water rights for a whitewater
course constructed on the Blue River, a tributary of the Colorado River, as it flows through
the Town of Breckenridge. Phase I of the whitewater course consisted of eight (8) separate
