BRIEF DESCRIPTION OF THE NATURE OF THE CASE. <br />A. General statement of the nature of the controversy. <br />This appeal involves a water matter tried before the Water Court for Water Division 5. <br />Applicant /Appellee, Town of Breckenridge sought conditional water rights for a whitewater <br />course constructed on the Blue River, a tributary of the Colorado River, as it flows through <br />the Town of Breckenridge.
