Town of Vail - Town Council - Town Council Highlights - Archive - October 2, 2001 Page 9 of 10
- -Gore Creek Whitewater Park Order of Remand
In response to a District Court order, the Council voted 7 -0 to approve
specific findings of fact and conclusions of law as they relate to the Tow
Council's previous decision to uphold the Planning and Environmental
Commission's approval of the Gore Creek Whitewater park. That approv
had been appealed by the Vail Center Association, which eventually file
a lawsuit against the town. In September, the District Court held that the
Town Council appeals hearing was inadequate for a proper court review
and ordered the Town Council to make specific findings of fact and
conclusions of law, which was the basis for Tuesday's Council action.
