Box 729, Monte Vista, Colorado 81144, <br />hereinafter referred to as the CotvTRACTOR. <br />FACTUAL RECITALS <br />A. Authority exists in the law, and funds have been budgeted, appropriated and otherwise made <br />available and a sufficient unencumbered balance the��gof remains available for payment in Fund <br />Number 424 Organization YYYY, Appropriation fjl�'�,�'GBL SLWC Program WTRC, Object Code <br />5560, Reporting Category 0042, Contract Encumbrance'NumberC150042. <br />B. Required approval, clearance, and coordination have been accomplished from and with appropriate <br />agencies. � . <br />C. The CotvT�uCTOR is a water activity enterprise within the meaning of § 37-45.1-101 et seg, C.R.S. <br />(1999), and was established by a resolution of the San Luis Valtey Water Conservancy District's <br />Board of Directors adopted May 19, 1999, incorporated herein by this reference, for purposes of <br />planning, financing, managing, implementing and operating the Rio Grande Headwaters Restoration <br />Project (" PROJECT "). The PRO�ECT entails a detailed cooperative planning investigation of the Rio <br />Grande River from the vicinity of the southern boundary of Alamosa County to near South Fork, Rio <br />Grande County, Colorado that will evaluate the feasibility of various restoration projects to improve <br />channel conveyance capacity, reduce vulnerability to flood damages, improve water diversion, <br />restore riparian habitat, and facilitate delivery of interstate compact commitments. <br />D. The CONTRACTOR Board of Directors has established an Advisory Committee that represents a <br />broad spectrum of water interests within the San Luis Water Conservancy District's boundaries. In <br />addition, various entities within the District's boundaries intend to participate in the PRO�ECT by <br />sharing costs or providing in-kind services. <br />E. The CONTRACTOR requested the STATE to participate in the PROJECT by sharing the CONTRACTOR'S <br />costs of consulting with the Advisory Committee and retaining one or more contractors to conduct a <br />feasibility study (" STUDY " ) for the PROJECT. <br />F. The STATE has determined that the information compiled in the STU�Y and implemented in the <br />PROJECT will directly enhance the STATE ability to meet its Rio Grande River Compact obligations. <br />G. At its January 1999 6oard meeting, the CWCB approved expending �20G,G00 from the Construction <br />Fund on STUDY costs. <br />H. Pursuant to Senate Bill 99-173, Section 10, the General Assembly authorized the CWCB to allocate <br />Page 1 of 6 <br />
