THIS CONTRACT, made this � day of 1996, by and
between the State of Colorado for the use and benefit of he Department of Natural
Resources, Colorado Water Conservation Board (CWCB) hereinafter referred to as the STATE
or the CWCB, and SOUTH PLATTE LOWER RIVER GROUP, INC., hereinafter referred to as the
GRANTEE and/or CONTRACTOR.
FACTUAL RECITALS
A. Authority exists in the law, and funds have been bud8eted, appropriated and
othervvise made available and a sufficient unencumbered balance thereof remains available for
payme�t in Fund�- Number 424, Organization YYYY, Appropriation A60, Program WTRC,
Object Code 5120, Cont�act Encumbrance Number C1537'��35. .;

with approp�iate agencies.

C. The Grantee is . a no�profit corporation organized under Articles 20 to 29 of Title
7, C.R.S. (1986 and Supp. 1995), located in Logan County, State of Colorado. The Grantee
is organized for the purpose of studying, demonstrating and developing opportunities,
locations, methods, criteria and other pertinent facts for diverting, storing and using water in
the lowe� South Platte River basin in Colorado under the provisions of the South Platte River
Compact.
D. The Grantee applied to the State for a grant in the amount of 575,000 to finance
a study to identify augmentation projects that will benefit numerous water user groups in the
South Platte River Basin ("Project"). The Project will entail hydrologic analysis and database
development, demonstration project identification and assistance, implementation of
demonstration projects, the establishment of a process for long-term agreements and funding,
and the preparation of a comprehensive report on the feasibility of future alternative water
resource management strategies and development opportunities in the lower South Platte
River basin ("Final Report"1.
E. The CWCB approved the grant at its November 7, 1995, Board meeting. Pursuant
to S.B. 96-153, the General Assembly authorized the CWCB to expend up to 575,000 to
cooperate with the Grantee on the Project.
NOW THEREFORE in consideration of the mutual and dependent covemants
contained herein, the parties agree as follows:
